No, both spouses need not file bankruptcy simultaneously. Therefore, if one spouse owes more debt than the other, it may make sense for just that spouse to file. However, if both spouses have a significant amount of debt, then a joint bankruptcy may be a better option. That being said, regardless, a joint filing isn’t necessary.
