After filing for bankruptcy, clients often ask will creditors be able to collect on the debt?
Nope! Immediately after you file for bankruptcy, the court issues an “Automatic Stay” that stops all creditor action. Therefore, creditors may not contact you in any way, nor collect on any debts you owed them. Once you receive your discharge order, your debt is legally nullified, and no creditor can try to collect on a legally discharged debt. If a creditor continues to attempt collection, that creditor may actually be liable to pay you for damages.
